  1. Fox News headed for trial, again, over 2020 election fraud claims

    I wrote a summary on the Dominion case if anyone is interested.

    On April 18, 2023, with the jury still seated and opening statements about to begin, Judge Eric M. Davis announced to the courtroom that the two parties in the case of Dominion Voting Systems v. Fox News Network had reached a settlement.

    The defamation lawsuit filed by Dominion originally sought $1.6 billion in damages and alleged that several prominent Fox News hosts and their guests had promoted false claims of Dominion Voting Systems being involved in an effort to rig the 2020 election in favor of Joe Biden.

    In one of the largest settlements of its kind in U.S history, certainly the largest defamation settlement by a news media corporation, Fox News agreed to pay $787.5 million to Dominion. Fox News first argued that its claims were protected by the first amendment and precedents like New York Times co v. Sullivan, but in a statement released by Fox News after the settlement, the network "acknowledged the court's ruling" that found claims made by hosts and guests of Fox News about Dominion Voting Systems were false, a statement that doesn't begin to underscore the magnitude of the case

    Dominion's case centered around allegations made on programs hosted by popular personalities like Tucker Carlson, Lou Dobbs, Sean Hannity, Maria Bartoromo and Jeanine Pirro. Dominion also focused on claims made by guests of these programs and attorneys of Donald Trump, Rudy Giuliani and Sydney Powell.

    During the pre-trial discovery phase, internal communications at Fox News were released and showed how executives and high profile hosts continued promoting these false claims despite being aware that they were false or misleading.

    The judge in the case ruled in a summary judgment that these statements made by Fox News and disputed by Dominion were false and ordered for a trial to take place to understand whether or not the network acted with actual malice.

    In U.S. law, and established by the supreme court in New York Times Co v. Sullivan, actual malice is a legal standard for libel (defamation) cases, wherein the plaintiff (especially in cases involving news media) must prove actual malice in order to win the case and recover damages.

    Actual malice has been defined as "with knowledge that it was false or with reckless disregard of whether it was false or not."

    Fox News filed a motion to dismiss the lawsuit twice. Once when they asserted that they were operating under their first amendment right to "inform the public about newsworthy allegations of public concern", and once when they cited the landmark case New York Times Co v. Sullivan, a case that established a constitutional basis for today's libel law and a high standard of actual malice as well as the principle that potentially libelous words can be protected by the first amendment.

    The judge in the case declined both motions and even allowed Dominion to sue the corporate parent of Fox News, Fox corporation, ruling that chairman, Rupert Murdoch and chief executive officer, Lachlan Murdoch may have acted with actual malice.

    The judge cited a report that detailed a conversation between both Rupert Murdoch and Donald Trump where Murdoch had communicated to Trump that he lost the election.

    In the pre-trial discovery phase of the case, Dominion acquired what was likely enough evidence to prove actual malice, or at the very least, enough information to get Fox News at the negotiating table to talk settlement.
    Communications between longtime hosts of the network and its top executives showed a clear understanding that the false statements being made on their programs were untrue. According to dominion's attorneys, prominent executives and hosts like Tucker Carlson and Sean Hannity even admitted to as much during sworn depositions.

    In one deposition, Hannity admitted that he "did not believe it for one second", in regards to claims made by Sidney Powell on his program.

    A court filing showed that primetime hosts of Fox News were texting each other messages that mocked Trump advisors and attorneys Sidney Powell and Rudy Giuliani for their on air comments and allegations related to a rigged election.

    This indicated that the hosts believed the claims were false, but they still promoted these false statements on their programs anyways. Some of these messages also revealed how Tucker Carlson doubted election fraud claims being made on his own program, he even publicly cast doubt on Sidney Powell's allegations when pressuring her to provide proof for her claims on his show.

    Messages were released of Rupert Murdoch himself admitting to the CEO of Fox News, Suzanne Scott, that he thought Trump's voter fraud claims were "really crazy stuff," while also telling Scott that it was "damaging everybody, I fear." Murdoch even acknowledged in a deposition that some Fox News figures were supporting election fraud claims and conspiracies that they knew were false.

    To make matters worse, a former Fox News producer also filed a lawsuit in 2023 alleging that she was pressured by the network's attorneys to give misleading testimony in the case.

    During this pre-trial phase of the case, it was reported that Fox News was searching for any evidence that might, in effect, prove some of the allegations and conspiracies of Dominion rigging the election.

    In the meantime, Fox stuck with the defense that any claims made on air were protected by the first amendment.

    Dominion, after receiving these Internal communications, filed a motion for summary judgment. Dominion believed that these messages indicated that top executives and hosts at Fox News had knowledge that the network was reporting false allegations of voter fraud on air, enough evidence to prove actual malice in court.

    A summary judgment was issued and a trial date set. Judge Eric Davis ruled that none of the statements related to Dominion rigging the election were true, and he also dismissed the argument that these claims should be treated as "pure opinion" protected under the first amendment, subsequently ruling that these claims were asserted as fact or "mixed" opinion.

    The judge also argued that even opinion isn't always constitutionally protected, and that Fox News could not invoke "the fair report privilege" in the upcoming trial, which essentially shields journalists from liability when they report on what they observe others say.

    Judge Davis also told Fox News attorneys that they could not use the argument that the network's coverage had "news value" as a protection against defamation. "Newsworthiness" is not a viable defense in a defamation case, an argument that Fox was allegedly intending to make.

    But on April 18, 2023, these pre-trial stipulations became irrelevant when it was announced in court, right before opening statements were made, that Dominion and Fox News attorneys had reached a settlement.

    In this case, it's pretty clear that the actions of Fox News meet the definition of actual malice. As Barbas et al (2023) put it, "fox settled because it knew that there was a very strong chance that Dominion would be able to meet the constitutional standard of actual malice". (Barbas et al., 2023). It's also clear that Fox News was going to have a difficult time invoking the first amendment as a defense. A settlement was reached, in part, for these reasons.

    Ok I have purchased and been a voice for Used cars 😂. Till date I have purchased many used cars and advocated them. So what matters most is - to get a used car from honest sellers and with background checks. Now let's say I wanna buy a XUV500 although it's stopped now but available in used market for you to enjoy. Also let's say I wanna buy XUV700 but don't have top dollar. You can still pay 60-70% of the price and can get used one today that too top variant.

    A lot diesel cars are discontinued like marutis but you wanna enjoy you can go for used.

    Same logic for luxury cars but you need to extra cautious.

    Now when it comes to value for money- nothing beats a good used car. I have and will only buy used car and flip it after 3 years. Then buy another one. Now savings enough to buy XUV500.

    I have had really good exp with spinny, you wouldn't believe. There was a deal in spinny for XUV500 diesel W6 2016 for 5.59L . Who would have thought - they can buy it for this price in Bangalore .

    So let's go used.

    Yes, uber is not available in Aligarh as far as I know, but you can easily find many rickshaws and autos and I don't know about the prices, before getting a rickshaw, buy something for ₹10 from a shop and ask them the rickshaw prices to your destination and also observe what and how they talk, it'll be easy to negotiate the prices.

    It's the peoples mindset that when someone buys a used car people instantly start to judge them personally I have experienced this.

    The same goes with transmission when someone buys a manual they tend to judge them and look down on them as compared to one with automatic. But this is not the case in America they love manual transmission especially those who are car enthusiasts

    There were total 16 mahajanpadas. Out of which 4 were from Bihar.
    And UP mein Kuru,Sursena,panchala,kosala, kasi.

    Most people are not aware about History of bihar even Biharis too.

    Reality hurts but bihari people themselves lack education. Especially those people who are labours, or do other jobs in different States.

    The most needed thing right now is education.
    And awareness about rich history of bihar.

    But neither of political parties are doing this.

    Nitish Kumar said bhojpuri will be included in Schedule 8 of constitution but isn't included.

    Nitish has best opportunity than ever, he is part of centre, he should do best for bihar during this time.
    But nothing is being done more than speeches and blame game.
