From akshara's point of view,he never listened on that phone call,he never called up again(could have done so through goenkas) to know what she wanted to say.She tells him in that scene where he confronts her after knowing abhir's truth that she wanted him with her,supporting her,at every stage of her pregnancy.
In her mind,she must compare her wishes to how abhiM actually behaved,he didn't even care to know what she wanted to say,so I can understand why she didn't want to share custody with him.She must think about all the complications she went through,and how abhiM wasn't there with her at all.
