OP, I am sorry that you have visual problems in one of your eyes. Your fears about your future are completely valid.

From what I could read from your Twitter post, it is definitely unethical to not explain to you about the procedure being done and the risks involved. I am unsure whether it (lack of explanation) is a case of Medical negligence. It's a huge problem in India owing to high patient load. Proper explanations regarding procedures aren't given to the patients and patients are at the burden of knowing what's being done to them. I acknowledge that it's wrong.

I feel bad again, because it will be difficult to prove Medical Negligence in your exact scenario. I am not a lawyer, however I am a Doctor and few things can absolutely be used to not connect your corneal scarring to the 'substance' used for VEP procedure.

1.) You had Photophobia before the procedure, which is one of the symptoms of corneal injury. Now someone can argue that temporally you might have had the injury already even before the test.

2.) You are not yet diagnosed with Multiple sclerosis (MS), but if it turns out to be indeed MS, someone can argue that your corneal injury is due to underlying MS. MS can be easily explained as the cause of corneal injury.

3.) You have used tissue paper to wipe off the substance from your eye once it was irritated. It can be argued that your corneal injury was caused by excessive damage by rubbing the tissue paper over it. I mean, it's the commonest cause of corneal damage. Now it will be difficult to prove whether your usage of Tissue paper is not excessive.

4.) Since the temporal relationship between the 'substance' and the 'injury' is not entirely clear (aka symptoms before the event), then the burden falls on you and your lawyer to link that substance with the injury. A medical professional will be asked to testify about the probability of that substance causing corneal damage. Unless we both are sure what was the substance that got applied and the damages it causes to the eye, we can't relate that to your corneal injury.

I am stressing again I am not a lawyer and I don't know the whole story. Kindly approach one and let them figure out the best course moving forward. A good attorney may easily figure out whether this is a case of Medical negligence or not. If it is, I pray that you get justice. If it is not, I pray that you have a good recovery in your eye and hopefully move on one day.
