KSRTC reports 1261 buses are over 15 years old; employees say real number exceeds 2,000
The Centre had earlier issued a directive to the state government to scrap all government vehicles older than 15 years. The state government, however, argued that the directive was discriminatory, claiming that KSRTC is a public enterprise rather than a direct government entity. Using this reasoning, it asked the MD of KSRTC to submit a request for an extension, allowing its vehicles to operate beyond the 15 year limit.
The request reached the secretariat, where the transport secretary, acting as a representative of the government, approved it with the transport minister’s endorsement. However, a significant conflict of interest arose since the MD of KSRTC and the transport secretary were the same person. In effect, he submitted a request to himself and then granted his own approval.
This decision effectively bypassed the central directive by exploiting a technical loophole, namely, the argument that KSRTC, as a public sector enterprise, is not strictly a government department. However, since KSRTC is still a state owned entity, the Centre could challenge this move legally, and its directive would likely take precedence.
The primary concern now is public safety. If the central directive is enforced, accidents involving KSRTC buses older than 15 years could face complications with insurance claims. Since insurance companies typically align with government regulations, they may refuse coverage for such vehicles, leaving passengers and victims at risk of financial losses. -
