Should I Join as an Independent Contractor or Form an LLC? (H-4 EAD, Founding Employee at Startup). I will not promote
I’m joining a US startup as a founding employee, but the founder wants me to start as an independent contractor instead of a full-time employee. I’m on an H-4 visa with an EAD, so I’m legally allowed to work. I’m debating whether to: 1) Work as an independent contractor (sole proprietor). 2) Form an LLC and contract through that Some considerations: •I’ll be doing core work for the company (not just a side gig). •I want to ensure liability protection, tax efficiency, and long-term stability. •The startup may transition me to full-time later, but no guarantees yet. Would forming an LLC (or even an S-Corp election later) be beneficial, or should I keep it simple as a sole proprietor for now? Any insights from folks who’ve been in similar situations? (I will not promote) Appreciate any advice!4
