Yesterday in the bus

I have a question regarding the senior citizen seat in the bus. I saw a senior citizen shooing away someone who was trying to sit in the seat next to him ( there were two seats) The seats were occupied and there was no other senior citizen in the bus. Legally speaking, was the senior citizen right?
