Need legal advice abt an road accident

One month back I met with an accident near Hitech City. I was on my bike, riding at 30-40 kmph. I slowed down before a speed breaker and a car hit me from behind. He was distracted by his phone and was not looking at the road. Bike got damaged, I got elbow fracture. I went to police station immediately and submitted an application for a case, he also came to police and submitted something against me. Police told him to settle everything by paying the hospital and bike insurance overhead charges. He paid the hospital bills that day and told us to share the bills post plaster removal. Some days back, doctor removed the plaster and suggested physiotherapy for a week (he wrote it in prescription) I sent the bills to the guy, but he is refusing now to pay. He told that he had lawyered up and won't pay a single penny. I went back to police station and they told to register a case on him now. So, before that I wanted to get some advice if I should go ahead and log a case or should I just forget about it. The expenses are around 15k now. If I go ahead, what are my chances to win? I have in written where he mentioned he'll pay for all bills, which was submitted to the police station.
